Mileage Reimbursement

Under NYS Workers' Compensation Law, you are entitled to be reimbursed for mileage incurred obtaining medical treatment for your work related injury. It is common for people to not be aware of this.

To make a claim for reimbursement for mileage you can contact your representative to obtain the form used to make the request - C-257, or you can obtain one from the NYS Workers' Compensation Board here.

Once you have the form, complete it. There is no need to put your Social Security number on the form. You need to put the date of your treatment, the name of the doctor, therapist or testing facility you traveled to and you need to put in your round trip mileage. When the form is complete, make a copy for your record. If you are represented, submit the form to your representative for him/her to submit to the carrier and if you are not represented, send it directly to the carrier. I recommend a brief cover letter, which states:

Enclosed please find my C-257 form for the period of date to date.

Please audit my request at your earliest convenience and reimburse me as indicated, or advise me why you cannot.

Thank you for your kind attention to this matter. Please contact me with any questions or need for further documentation.

Very truly yours, etc.

Bear in mind the adjuster needs a copy of the report from the provider to substantiate each visit claimed. Sometimes it can take as much as four weeks for the reports of your visits to get to the carrier and to be filed with the WCB. It is best to let your request lag behind your visits three to four weeks.

Also, these requests rank low on an adjuster's list of priorities. As a result, I would recommend waiting thirty days for a response from the carrier. Hopefully, the response will be a check. If a month goes by with no response, ask your representative to contact the carrier, or if you are not represented contact the carrier yourself and politely inquire regarding the status of the C-257 submitted on whatever date, covering the period of date to date.
